Party A (Guarantor):
Party B (Issuer):
To guarantee to realize Party B's creditors' rights, Party A voluntarily provide guarantee for_____________________(Hereinafter referred to as the "warrantee"), whose valid ID certificate number or the unit registration No._________________, with respect for applying for Peony Quasi-Credit Card from Party B. The Guarantee Contract is entered into through negotiation between the both parties.
I. Definition: the warrantee herein refers to holding unit or personal individual of the Peony Quasi-Credit Business Card.
II. Guarantee responsibility scope: all the liabilities occurred under the Peony Quasi-Credit Card under the Peony Quasi-Credit Card Application Contract with No._______________signed between the warrantee and Party B (including principal and interest within or beyond the credit limit and recovery fees) and expenses for Party B to realize its guarantee rights. The repayment priority by Party A for the debt of the warrantee is interest, expenses and principal.
III. Guarantee Responsibility Mode: Joint Responsibility Guarantee
IV. Guarantee Period: two years from the next day of the expiration of overdrawing period under the Peony Credit Card of the warrantee. If the cardholder overdraws for many times and doesn't repay within the effective period of the Peony Credit Card Contract, the guarantee period will be calculated separately. Party A shall unconditionally fulfill its corresponding guarantee responsibility, otherwise, Party B shall have right to recover them from Party A.
V. Representation and Guarantee of Party A
I) Party A acknowledges it has known and understood ICBC Peony Quasi-Credit Card Procedures, Peony Quasi-Credit Card Contract and the Contract Text and is willing to provide guarantee to the warrantee on the condition that Party A knows the credit standing and card use intention of the warrantee;
II) Party A acknowledges it has corresponding guarantee ability and has fulfilled necessary approval procedures.
III) Party A acknowledges it provides true, legal and effective materials and is willing to actively cooperate investigation of credit standing with Party B.
VI. Party A shall have right to know increase and decrease of number of cardholders of the Peony Quasi-Credit Card of the warrantees.
VII. Party A shall give a notice to Party B in writing immediately when the contents filled in the application form are changed. Party A shall take responsibility for the economic losses arising from this if it fails to fulfill the obligation.
VIII. If Party A needs to terminate the contract during the effective period of the contract, it should submit a written application, the contract will be terminated until the warrantee provide other guarantee accepted by Party B or the account is cancelled. Nevertheless, Party A shall take the responsibility for debt repayment occurred before termination of the contract.
IX. Party A's guarantee responsibility shall not change due to amendment of laws, regulation and procedures attached by the Peony Quasi-Credit Card Procedures or amendment of the procedures, change of charger items or standards of the warrantee, interest rate adjustment, midway card change by the warrantee, increase or decrease of the warrantees and adjustment of credit limit of the warrantee, etc.
X. The contract will not lapse with lapse of the Peony Quasi-Credit Card Application Contract signed between Party B and the warrantee.
XI. Disputes in connection with the agreement shall be settled through negotiation between both parties. If no settlement is made, the disputes shall be submitted to the local Peoples' Court of Party B for lawsuit.
XII. The contract comes into effect upon signing and signature by both parties and expires upon account cancellation by the card holder.
