ICBC Internet Banking Personal Customer Messenger Service Agreement
Party A:jinrong@jia Party B: ICBC
Party A signs the agreement to voluntarily use Party B's ICBC Messenger Service and to specify rights and obligations of both parties.
I. ICBC Messenger Service is a paid info service provided by Party B to Party A. After Party A and Party B online sign ICBC Messenger Service Agreement, Party B provides Party A with service of information ordered by Party A through mobile phone messenger or email.
II. Party B will provide Party A with six categories of messenger service contents: financial and economic news, Account Info, important notice, free gift info, balance change reminding and bank statement of personal account. Detailed service contents, Sent by and charge standards are publicized in the introduction of the messenger service. Party A well knows the detailed service contents, Sent by and charge standards before using Party B's messenger service.
III. Party A should reserve mobile phone number or email according to service item as well as payment account number Party A must guarantee reserved information to be correct. Party B takes no responsibility for Party A failure to receive Info because Party A's reserved Info is not detailed enough or correct enough.
IV. When Party A authorizes Party B to apply messenger service, payable service fees are deducted from Party A's reserved payment account. If Party A's reserved payment account is cancelled or account is at abnormal status and has insufficient balance, Party A can't collect messenger service fees in time, Party B will not provide the service and takes no responsibility for this.
V. If Party A's mobile phone number, email and payment account number are changed, Party A should modify them through ICBC Messenger Service (PartyB's Internet Banking). If Party A's information above changes but not be modified in time, resulting in Party A's failure to receive messenger service info or info disclosure, Party B takes no responsibility for this.
VI. Party B reserves the right to terminate and cancel the agreement unilaterally in the event of the following when Party A fails to cancel the service: 1. Complaint made by owner of the mobile phone if wrong mobile number is supplied by Party A; 2. Party A fails to inform Party B of any change in the mobile number. 3. Party A fails to pay the applicable fees when due.
VII. Party B takes no responsibility for Party A's failure to receive service message due to communication trouble or force majeure.
VIII. Party A cancels ICBC Messenger Service, but related fees already paid are not returned by Party B. If Party B cancels the service, Party B will terminate providing ICBC messenger service.
IX. Party B should keep confidential for information provided by Party A, except for those otherwise specified by laws and regulations.
X. The agreement comes into effect upon signing date and expires on the date of service cancellation.
XI. The agreement is applicable to laws of the People's Republic of China and generally financial practice unless otherwise expressly specified.
XII. The agreement shall be construed and modified by headquarter of the Industrial and Commercial Bank of China.
