In connection with Party A (风车) wishes to buy online investment product offered by Party B (ICBC) and for consideration deemed by the Parties to be mutually acceptable, the Parties agree to enter into the following Agreement:
Article 1 Party A hereby declares and acknowledges: (Party A is an individual with full civil capacity) Party A acknowledges and agrees to be bound by the rules and regulations stated in ICBC Regulation of RMB Investment Product when buying such Product. Party A has read and understood the Product Description. There is no questions or disagreement on the terms. Party A uses own available funds to buy the Product offered by Party B through Internet. Party A understands the nature of the product and the risk of the investment. Party A has carefully examined the tolerance for all the risks involved in the investment.
Article 2 Buying investment product online can present different risks which may include credit risk, interest rate risk or liquidity risk. Party B’s Product Description provides the risk disclosure information as needed.
Article 3 Following are integral part of the Agreement herein: Description of the Product bought by Party A via Party B's website, personal particulars supplied and confirmed by Party A, terms and conditions agreed on the Product. Each Investment Product Agreement is wholly separate and independent from one another in its validity and performance.
Article 4 Party A authorizes Party B to transfer necessary amount from Party A's bank account to buy the investment product stated in the Agreement herein. Party A shall not ask for any refund from Party B or cancel the bank account prior to the maturity of the Product, unless otherwise the Product is terminated as stated in this Agreement.
Article 5 Return paid by Party B for Party A's investment in the Product is pre-tax earning. ICBC will not be liable for any tax payable by Party A.
Article 6 Party B reserves the right to collect management fee from Party A. Details of the fee schedule and collection will be announced in Party B's website or stated in the Product Description.
Article 7 ICBC Regulation of RMB Investment Product is the Addendum of the Agreement herein and has equal legal binding.
Article 8 The present Agreement comes into force from the date of its signing by the Parties and will be automatically terminated in the event of the Product is bought
